Service Agreement // Effective March 5, 2026
Please read these Terms carefully before using MyCapsule. These Terms affect your legal rights. This document is provided as a starting point and does not constitute legal advice.
Acceptance of Terms
By accessing or using MyCapsule ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and TechHive Services ("we," "us," or "our").
Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements. We do not knowingly collect personal information from children under 13. If we learn that a user under 13 has created an account, we will terminate that account and delete their data.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at chris@techhive.services if you suspect unauthorized access. We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion.
Content License Grant
By uploading, submitting, or otherwise making content available through the Service ("User Content"), you grant TechHive Services a worldwide, non-exclusive, royalty-free, sublicensable license to store, host, reproduce, display, distribute, and transmit your User Content solely as necessary to operate and provide the Service. This license ends when you delete your User Content or your account, except where your content has been shared with others who have not deleted it. You represent and warrant that you own or have all necessary rights to grant this license and that your User Content does not violate these Terms or any applicable law.
User Responsibility
You are solely responsible for all User Content you upload, publish, or otherwise make available through the Service. You represent that (a) you own or have the necessary rights, licenses, and permissions for all User Content; (b) your User Content does not violate the privacy rights, publicity rights, intellectual property rights, or any other rights of any person; and (c) your use of the Service complies with all applicable federal, state, and local laws.
Prohibited Content
You may not upload, post, or transmit any content that: (a) is illegal under applicable law; (b) constitutes child sexual abuse material (CSAM) or sexualizes minors in any way; (c) infringes any copyright, trademark, patent, or other intellectual property right; (d) is defamatory, harassing, abusive, threatening, or constitutes hate speech; (e) contains malware, viruses, or malicious code; (f) violates any person's reasonable expectation of privacy (including non-consensual intimate imagery); or (g) is otherwise objectionable in our sole discretion. We reserve the right to remove any content and terminate any account that violates these prohibitions without prior notice.
Copyright & DMCA Takedown
TechHive Services respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Service infringes your copyright, send a written notice to our designated DMCA agent at chris@techhive.services containing: (1) a physical or electronic signature of the copyright owner or authorized agent; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the allegedly infringing material and its location on the Service; (4) your contact information (name, address, phone, email); (5) a statement that you have a good-faith belief the use is not authorized by the copyright owner; and (6) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner. Counter-notices may be sent to the same address. TechHive Services will respond to valid takedown notices in accordance with applicable law.
Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), it is our policy to terminate the accounts of users who are repeat infringers of intellectual property rights. We may also, in our sole discretion, limit access or terminate accounts of users who infringe any intellectual property rights, whether or not repeat infringement has occurred.
Indemnification
You agree to indemnify, defend, and hold harmless TechHive Services, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHHIVE SERVICES AND TECHHIVE SERVICES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR SERVICE INTERRUPTIONS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $50 USD. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSIONS OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED/ERROR-FREE SERVICE. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY ERRORS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, by sending a notice to the email address associated with your account. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
